Discovery Laboratories (Nasdaq: DSCO) 53% LOWER; learned that the FDA will now apply a newly-defined standard to determine whether Discovery Labs has adequately demonstrated comparability of Surfaxin clinical to commercial drug product.

This new standard represents a significant hurdle for approval of Surfaxin. Lear Corporation (NYSE: LEA) 22% LOWER; NYSE Regulation has determined that the common stock of Lear Corporation (NYSE: LEA) should be suspended immediately, saying it is no longer suitable for listing on its planned Chapter 11 filing.


 

Lear, the Auto Parts Maker, Files Chapter 11

The maker of car seats, the Lear Corporation , said on Wednesday that it would file for bankruptcy protection in a reorganization supported by crucial secured lenders and bondholders and that it had obtained $500 million in bankruptcy financing.

Lear Corporation (NYSE: LEA) 36% LOWER; announced today that the Company has reached an agreement in principle regarding a consensual debt restructuring with steering committees representing its secured lenders and its bondholders.

The Company plans to commence shortly the proposed restructuring under court supervision pursuant to a voluntary bankruptcy filing under Chapter 11 of the United States Bankruptcy Code by the Company and certain of its U.S. and Canadian subsidiaries.

Keryx Biopharmaceuticals, Inc. (Nasdaq: KERX) 52.8% HIGHER; reports Q1 EPS of $0.01, 9 cents better than the analyst estimate of ($0.08) and compared to a loss of $0.79 in the same quarter last year.

Revenue for the quarter was $3.3 million, versus the consensus of $320K. Lear Corporation (NYSE: LEA) 20% LOWER; reports Q1 loss of $3.42, versus the analyst estimate of ($1.73).
