Fairey’s letter: “I believe you have willfully infringed our rights under 17 U.S.C. Section 101 et. seq. and could be liable for statutory damages as high as $150,000 as set forth in Section 504(c)(2) therein.” The Associated Press and the artist Shepard Fairey have reached a settlement in their copyright battle over Mr.

US Copyright Office - 23-Month Wait on Registration

I am someone who strongly encourages everyone to register their copyright.

Doing so is your ticket to federal court when you are infringed, and provides for remedies like statutory damages and repayment of attorney's fees when you win.

Orphan Works - A Unique Set of "Myths" and "Facts"

Recently, the well meaning folks at Public Knowledge purported to demystify the Orphan Works bills, suggesting their own series of "Myths", and offering up "facts" (Orphan Works Myths and Facts).

The problem is, the PK folks just can't have their own set of facts. To that end, we've taken the opportunity to "bust", correct, clarify, shoot holes in, or otherwise offer a contributing attorney’s criticism of the PK "Facts".
